BRIEF HISTORY OF THE INSTITUTE

The Chartered Institute of Taxation of Nigeria started on February 4, 1982 as Association of Tax Administrators and Practitioners. Thereafter, it transformed into Nigeria Institute of Taxation, which was formally launched on February 21, 1982 and statutorily recognized on May 6, 1987 as company Limited by Guarantee.

The Institute was chartered by the Federal Government of Nigeria by the enabling Act No. 76 of 1992 (now CITN Act, CAP C10, Vol. 2, Laws of the Federation of Nigeria, 2004) and was charged with the responsibility, among others, of determining what standards of knowledge and skills are to be attained by persons seeking to become a professional Tax Practitioner or Administrator.

THE CHARTER OF THE INSTITUTE

The aims and objects of the Institute as laid down in its charter (Decree 76 of 1992) among others are:-

  • To determine what standards of knowledge and skill are to be attained by persons seeking to become registered members of the taxation profession.
  • To raise, maintain and regulate the standard of taxation practice amongst its members.
  • To promote professional ethics and efficiency in tax administration and practice.
  • To encourage, promote and co-ordinate research for the advancement of taxation practice and administration in Nigeria.

Under the Decree, the Institute is the only professional body which has the authority to regulate Tax Practice and Administration in Nigeria and only its members can practice Taxation. The Decree sets out the rules as regards membership, composition and officers of Council, etc. and copies are available for sale at the Secretariat of the Institute.

COUNCIL AND ITS OFFICERS

Council is the governing body of the Institute. It is headed by the President who is its Chairman. The Vice-President is the Vice-Chairman. Section 3 of the Act sets out the rules governing the election, composition and terms of office of Council members as follows:

  • A Chairman who shall be the President of the Institute;
  • A Vice-Chairman who shall be the Vice-President.
  • The Chairman of the Federal Inland Revenue Service or his representative not below the rank of a Director;
  • Two representatives of the Joint Tax Board.
  • Fifteen persons elected by members of the Institute.
  • A representative each of the following Ministries: Finance and Economic Development and Education
  • Two persons to represent institutions of higher learning in Nigeria. The two shall not come from the same Institution.

A member of Council shall hold office for a period of three years after which he retires and thereafter be eligible for re-election. Election to Council is held annually at the Annual General Meeting and is by secret ballot. The rules governing this election are contained on pages 6 to 8 of the Membership Rules and Regulations. The Act gives Council absolute powers to do anything, which, in its opinion, is necessary to carry out the activities of the Institute.

THE COMMITTEES OF COUNCIL

Council usually appoints Committees with specific Terms of Reference to assist in carrying out its duties under the Act and such Committees must report to the Council together and forward their recommendations from time to time. The Chairman and Vice-Chairman of each Committee shall be members of Council. Every decision or recommendation of Committee must be ratified by Council otherwise such decision would be null and void.

New members should avail themselves of the opportunity to join any of the Committees so as to contribute meaningfully to the development of our great Institute.

N.B: A presidential year is June of a year to May of the following year.

THE SECRETARIAT OF THE INSTITUTE

Council serves as the governing body for the Institute’s affairs in formulating policies for the Secretariat to implement. In ensuring an effective administration of the Secretariat, the Registrar/Chief Executive who also serves as the Secretary of Council heads the Secretariat.

The Registrar/CE, through the Heads of Departments, administers the various activities of the Institute. These Heads of Departments also serve as the Secretary to Committees of Council. The Secretaries/Heads of Departments are responsible to the Registrar/Chief Executive and or the Director (Finance/Administration) in carrying out their responsibilities. Enquiries about issues relating to the Institute could be obtained from the Heads of the Department associated with tasks to which such enquiries are needed.

The Institute’s Secretariat is situated at Don De Dieu Plaza, 11, Ikorodu Road, Opposite CPI-Moore, Maryland, Lagos. The Secretariat is structured in line with the objectives of the Institute in order to meet the various needs of the society i.e. members or non-members. This is as stated below:

PROFESSIONAL DISCIPLINE

Council has set up machinery to deal with cases of professional misconduct by any member of the Institute. These are the Investigation Panel and the Disciplinary Tribunal.

The procedure is that any form of misconduct by a member which is likely to damage the reputation of the Institute or the profession shall be referred to the Investigation Panel, which investigates the allegation and if deemed necessary, refer such case to the Disciplinary Tribunal. The duties of the Tribunal and the Investigation Panel are set out on pages 12 to 15 of the Membership Rules and Schedule 2 of the Act.

However, a member of the Institute shall be liable to be removed or suspended from membership by Council if he:

  1. Violates fundamental rules of the Institute applicable to him, or
  2. Is convicted of felony or misdemeanour, or
  3. Is finally declared by a court of competent jurisdiction to have committed a fraud, or
  4. Had been found guilty of any act of default discreditable to the Institute, or
  5. Is adjudged bankrupt, or
  6. Fails to satisfy a judgement debt, or
  7. Is declared lunatic, or
  8. Willfully commits any breach of the regulations of the Institute, or
  9. Fails to pay any subscription or other sums payable by him to the Institute for 2 years after same shall have become due, or
  10. Fails to participate in the Mandatory Professional Training Programme of the Institute.

INDUCTION OF NEW MEMBERS

The induction ceremony is intended to expose new members to the institute’s rules/regulations, professional code of conduct. It will also avail them the opportunity to know more about the Taxation Profession, the Institute and the Secretariat.

As part of its efforts to properly orientate new members on taxation, the Council has made induction ceremonies mandatory for all newly admitted members with effect from January 1, 1997. Participation in the programme in the opinion of Council, will equip such new entrants to face the challenge of the profession and instill in them a sense of belonging to the Institute.
